Did you lose a loved one admitted to the oncology ward at Newcastle’s Calvary Mater Hospital in the period between Jan 2024 - Apr 2025?
If your family member developed fatal pneumonia while being treated at Calvary Mater we would like to speak to you.
XD Law and Bilbie Faraday Harrison join forces to uncover what happened to patients exposed to a deadly mould in the Calvary Mater cancer unit.
Last week’s health department data showed that the pneumonia fatality rate at Calvary Mater is far above state average, and now we know why. We would like to hear your story to see if it’s suitable for a class action.
We are currently gathering expressions of interest from individuals who have been affected. Submitting your details does not commit you to anything - it simply allows our legal team to assess your eligibility.
“They went to the hospital, they didn’t come out of the hospital, the reason was pneumonia a classic symptom of mould infections”

Oct 2024 BHI Hospital Mortality Report
Throughout 2024 the mould problem was blooming in the air vents throughout the ward. The maintenance contractor, US services giant Honeywell, appears not to have appreciated the threat that such mould poses to immune suppressed patients. It has been reported that in OCTOBER 2024 they received maintenance information that the mould and collapsing AC vents had reached a critical stage of decay. They decided not to tell the hospital, not to give the Doctors and Nurses a chance of warning their patients. To tell them to go to another hospital, to go home, to go anywhere but the Calvary Mater oncology ward. For 6 long months.
Against this backdrop, an astounding report into mortality following hospitalisation was published just a few weeks ago by the Bureau of Health Information, revealing that Calvary Mater had a higher-than-expected mortality rate for pneumonia, despite a statewide decrease.
Family members and patients should have faith that when they enter hospitals they will be cared for and safe, and trust that they’ll come out healthier than they went in.
XD Law and Bilbie Faraday Harrison are leading a class action for family members of those patients who died between January 2024 - May 2025.
If your loved ones were affected, particularly if Pneumonia was listed as a cause of death, we encourage you to reach out by completing the expression of interest form at the top of this page.
